Terms and Conditions

Following are the Terms and Conditions between Wine Ventures Ltd trading as Vinopic Wines (and in the Terms and Conditions hereafter referred to solely as “Vinopic Wines”) and you, the customer. If you visit, use, register, transact or buy wine from Vinopic Wines or the Vinopic Wines website, found at www.vinopic.com, then you can only do so on these Terms and Conditions. By visiting, using, registering or transacting on the Vinopic Wines website you are agreeing to be bound by these Terms and Conditions. We hope you will agree that they are fair and give protection to both yourself and Vinopic Wines. We may change these Terms and Conditions from time to time by updating this page.

1. Data Protection

Vinopic Wines is wholly committed to the Data Protection Act 1998, and is dedicated to the privacy of your information.

2. Privacy Policy

Vinopic Wines takes your privacy very seriously. Vinopic Wines will not communicate your details to any third party without your prior consent, other than affiliated third parties when this is necessary to fulfil your order (e.g. warehouse operators, delivery couriers etc.).

When you register and sign-up to Vinopic Wines, or when you purchase wines from the Vinopic Wines website as a “guest”, you are agreeing to Vinopic Wines processing, maintaining, storing and using your personal data, which we collect in order to enable us to fulfil your order. This information includes your orders, order history, personal information, contact details, address details, wine preferences, communication preferences, etc.

Vinopic Wines does not retain any financially significant information on its customers such as bank card details. All these details are processed and captured outside the Vinopic Wines website and in accordance with the Payment Card Industry Data Security Standards (PCI DSS). Please refer to clause 3 for further information.

When registering with Vinopic Wines to receive newsletters and/or post we may, from time to time, use this information about you to contact you with sales or marketing related communications. You may be contacted via email and/or post in accordance with your selection in the newsletter and contact preferences of your personal account on the Vinopic Wines website. In this instance only, your email address or postal address may be provided under strict guidelines to a third party supplier for the sending and distribution of emails or post.

If you opt-out from receiving this communication from Vinopic Wines, and/or associated third parties, you will only be contacted by Vinopic Wines with regards to operational issues including, but not exclusively, information relating to orders and delivery confirmation, informational, non-marketing, emails and significant changes to these Terms and Conditions. Phone calls from or to Vinopic Wines may be monitored or recorded for training and quality purposes.

You should also be made aware of the fact that Vinopic Wines uses web 'cookies' which are placed in your web browser to help us collect general information regarding your browsing experience on the Vinopic Wines website. This enables Vinopic Wines to constantly monitor and improve the Vinopic Wines website functionality and your user experience. If you rather Vinopic Wines does not collect this information please consult your web browser's help pages to disable cookies in your web browser.

3. Security

Shopping with Vinopic Wines is completely secure. To increase your piece of mind and the overall security of the website, all your credit card information and payment information are never stored or transacted on the Vinopic Wines website or systems. Instead all this information is securely transacted and stored on Sage Pay’s secure servers. Sage Pay is the UK’s leading independent payment services provider, processing millions of secure payments each month for over 30,000 businesses.

Sage Pay’s systems are scanned quarterly by Trustwave which are an independent Qualified Security Assessor (QSA) and an Approved Scanning Vendor (ASV) for the payment card brands. Sage Pay is also audited annually under the Payment Card Industry Data Security Standards (PCI DSS) and is a fully approved Level 1 payment services provider, which is the highest level of security compliance. Sage Pay are also active members of the PCI Security Standards Council (SSC) that defines card industry global regulation.

All transaction information passed between Vinopic Wines and Sage Pay’s systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to Vinopic Wines’s servers from Sage Pay are signed using MD5 hashing to prevent tampering. You can be completely assured that nothing you pass to Sage Pay’s servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

Once on Sage Pay’s systems when clicking “Proceed to Pay”, all sensitive data is secured using the same internationally recognised 256-bit encryption standards used by, among others, the US Government. The encryption keys are held on state-of-the-art, tamper proof systems in the same family as those used to secure VeriSign's Global Root certificate, making them all but impossible to extract. The data Sage Pay holds is extremely secure and they are regularly audited by the banks and banking authorities to ensure it remains so.

Sage Pay has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.

Entry to Sage Pay is controlled by Iris Scanners, which are the latest and most precise biometric security devices available for identification and as used by chemical plants, airports, police stations, prisons and other facilities where security is paramount. In addition, no one can enter or leave Sage Pay’s building without a valid security pass.

Furthermore, Sage Pay operates on twin data centres to ensure optimal system security and up-time and has a full disaster recovery and business continuation policy.

It is your responsibility to protect your username and password from being disclosed to any third party.

4. Disclaimer

Whilst Vinopic Wines endeavours to ensure that the information on its website is correct, accurate and up to date, Vinopic Wines takes no responsibility if some or all of this information is inaccurate, incomplete or out of date. Vinopic Wines shall not be held liable to any individual or business for any damage or loss which may have occurred from the use of any material contained on this website.

Unless specified, all text and graphics displayed on this website are directed exclusively at those who access the website from the United Kingdom. Vinopic Wines makes no representation or will not be held liable for any action placed upon Vinopic Wines by individuals from other locations.

Vinopic Wines assumes no responsibility whatsoever for any links to third party Internet websites that may be accessed from the Vinopic Wines website. Once you click through to these links and leave the Vinopic Wines website, Vinopic Wines will not be responsible, or liable, for the content of any other websites on the Internet to which you may be re-directed.

5. Intellectual Property Rights

When using the Vinopic Wines website, you are permitted to do so in accordance with these Terms and Conditions. Written consent must be obtained from Vinopic Wines before you use any part of the Vinopic Wines website in any other way.

All copyright, trademarks, database rights, and any other intellectual property rights relating to the content of the Vinopic Wines website, such as text, logos (including the Vinopic Score displayed throughout the website, together with their graphical and numerical representations), graphics, banners, taglines, images, buttons, underlying source code and software, is the sole property of Vinopic Wines, or the applicable licensor.

All persons, individual and corporate, are prohibited from providing hypertext and/or other links to the Vinopic Wines website, other than to the Vinopic Wines website homepage, from their own website or from a third party's website, without Vinopic Wines’s prior written consent. Any use (including copying, duplication, reproduction, transmission, or display of the content of this website, without the express written permission of Vinopic Wines) for purposes other than the viewing of information or for ordering purposes, is strictly prohibited.

Vinopic Wines grants permission to electronically copy, and to print in hard copy, portions of this website for the sole purpose of using this website as a shopping resource and/or placing an order for wines on the Vinopic Wines website.

The company logos and taglines together with photos of key members of the Vinopic Wines team are available for download by persons or organisations involved in the press.

Press members are free to use these images provided that:

a) Vinopic Wines is forewarned about the use of these images in articles or press features, prior to the release to the general public of these articles or press features.

b) Access is provided to the press article, press release and/or press feature post the publication of said article, release or feature.

6. Returns, Cancellation Policy and Refunds

If you place an order with Vinopic Wines and one or more of the bottles you receive is/are broken or spoilt upon delivery we will provide you with a full refund on the broken or tainted wine. We may require the tainted and/or broken wine bottles to be returned to us, at our cost, and this will be arranged at a time of your convenience.

If you do not have the original packaging anymore, please contact Customer Care to arrange for replacement packaging to be sent when the wines are ready to be returned. An invoice or receipt for the wines you wish to return will have to be provided in order to receive a refund.

Occasionally, we have to substitute wines in your order for a later vintage or an alternative wine of equal or greater commercial value. If you are unhappy with any of the substitutions that may occur, provided the bottle(s) are unopened and intact, we will arrange collection at Vinopic Wines’ cost.

If you want to cancel your order, you may do so up to and including 7 working days from the date your order is delivered, provided all the bottles are unopened and intact and provided you inform Vinopic Wines in writing of your wish to do this. Cancelled orders will carry a delivery surcharge which will be deducted from your refund.

Refunds will be calculated on the value of the order (excluding delivery) less returns charges and/or other charges for broken or damaged bottles, which are charged at the commercial value of the bottle plus any taxes and as displayed on the Vinopic Wines website. Refunds will be processed within 30 days from the date of receipt of the returned wines.

If for whatever reason Vinopic Wines cannot or will not despatch part or all of your order, you are entitled to a part or full refund on the wines purchased according to what has not been dispatched. This refund shall be processed within 30 days from the date your payment is taken. This clause should be read in conjunction with clause 14 below.

If you are entitled to receive a refund this will be paid as follows:

  • If you paid your order by a credit, debit or other type of payment card, we will refund you on the card used for the payment of that order;
  • If you paid your order by Gift Card we will refund you on a bank card you provide or send you a cheque in the post.

When purchasing from Vinopic Wines you acknowledge that due to the nature of the goods being sold, wines being made from natural products, their quality may vary for different time periods. However, Vinopic Wines warrants that as at the date of delivery these wines shall reasonably correspond to their description. Vinopic Wines gives no warranty as to the durability of the wines.

You must notify Vinopic Wines of any wines that are due to be returned for any reason as soon as possible and within 7 working days from receipt of the wines.

You can access your orders and order history from the “My Orders” section in your account section.

Complaints are taken very seriously at Vinopic Wines and we endeavour to respond to them as soon as possible.

7. Age Restriction

It is illegal in the United Kingdom to supply or sell alcohol to anyone who is under the legal drinking age of 18. By placing an order with Vinopic Wines (by phone or via the Vinopic Wines website) you confirm that you are over 18 years of age on the date of purchase.

11. Delivery

Vinopic Wines delivers throughout all of the United Kingdom (including Northern Ireland, the Highlands, Scottish Islands and the Scilly Isles, and other “Out of Area” postcodes, see Clause 12 for more details) through its courier company City Link. Vinopic Wines does not currently deliver outside of the United Kingdom.

Vinopic Wines offers you various types of deliveries to better cater for your needs. For our normal geographical areas, delivery starts at £5.99 but some delivery types are free. Below is a table summarizing delivery charges for all non Out of Area or Central London postcodes for different tiers of your total basket value:

We will aim to deliver your order all at once but sometimes when you order more than one case it may happen that you will receive separate deliveries. Should this happen we will endeavour to let you know in advance and this will not affect your delivery charge.

Delivery will be made at the address you specify when placing your order on the Vinopic Wines website or over the phone. Vinopic Wines makes every effort to deliver your wines on time and within the delivery window you have selected. However, Vinopic Wines will not be held liable if the order is not delivered on time, in part or in full, due to circumstances beyond Vinopic Wines’ control.

We normally deliver Monday to Friday 07:30 to 18:00 unless you have scheduled a specific time window for your delivery. For deliveries marked as “Next Day”, orders need to be placed before 12:30, Monday to Friday, for them to be delivered on the next working day. Orders completed after 12:30 on a week day or on the weekend will be calculated as being taken on the following working day and will be delivered one working day after that.

For deliveries marked “Up to 4 working days (anytime)” orders need to be placed before 12:30, Monday to Friday, for them to be delivered up to 4 working days (anytime) after. Orders completed after 12:30 on a week day or on the weekend will be calculated as being taken on the following working day and will be delivered 4 working days after that.

For deliveries marked “Following Saturday” orders need to be placed before 12:30, Monday to Friday, for them to be delivered on the next Saturday. Orders completed after 12:30 on a Friday for “Following Saturday” delivery will be delivered the Saturday after next.

We do not deliver on bank holidays and other national holidays so please bear this in mind when placing your order.

All deliveries require a signature. Should you not be at the specified delivery address when City Link attempt delivery, the driver will drop a card at the address to let you know they have attempted the delivery. This card will contain full instructions on what to do next to reschedule delivery. It is very important you take immediate action to reschedule delivery. If you do not get in touch with City Link before 23:00 on the same day the card is left at the address, City Link will automatically re-attempt delivery the following working day. Delivery will be re-attempted once (second delivery attempt) free of charge after which a second delivery charge will be levied. This charge will be equal to the original delivery amount plus a variable administration charge. You reserve the right to collect the wines free of charge from your local City Link depot within the time specified on the card left by City Link.

13. Prices, Payment and Acceptance of Payment

All prices you will see on the Vinopic Wines website are quoted in British Pound Sterling and may refer to Bottle prices or Case prices as appropriately marked. The prices include all relevant duties and taxes unless otherwise specified. Delivery is charged separately dependent on the delivery address and type of delivery chosen.

We accept payments from most types of debit and credit cards but we regret to inform you that due to the high commission prices levied and transactional times needed by American Express to process payments, we do not currently offer payment with American Express cards.

When shopping for pre-mixed cases the discount quoted is calculated on the non-discounted prices of the constituent wines.

We reserve the right to terminate or amend any special offer at any time and without prior notice but never after an order comprising a special offer is placed.

Your debit or credit card will be charged once you place your order. You will not be able to amend your order after this stage.

When you place an order you are agreeing to buy the wines in your basket from us. Nothing we do or say will amount to an acceptance of your order until such time when your wines are dispatched from our warehouse at which point a contract and contractual obligations will be made between Vinopic Wines and you. If for any reason, we decline to supply any wine or group of wines to you, you are entitled to a full refund for any amount you have already paid in accordance with the refund policy in Clause 6 above.

Vinopic Wines makes every effort to ensure all pricing information displayed on the Vinopic Wines website is correct and up to date. Occasionally it may happen that wines or special offers are mispriced. If we discover a mispricing it is at Vinopic Wines’ discretion to change it at any time before you have placed your order. Should you have already placed your order on the mispriced wine or offer, we reserve the right to cancel the mispriced part of your order or to contact you to ask whether you still want to proceed with the order at the corrected price. Under no circumstances will we be obliged to supply wines at the incorrect price.

14. Reviews, Comments and Content

Registered customers will be able to post reviews of wines, comments, and other content. The right to post content is granted on condition that the content is not illegal, abusive, defamatory, threatening, obscene, infringing of intellectual property rights, invasive of privacy, or otherwise injurious to third parties, or objectionable. More specifically, content should not include links to other websites, political campaigning, commercial solicitation, software viruses, mass mailings or chain letters.

Vinopic Wines’ systems also check for false email addresses and you are not permitted to use false email addresses or email addresses belonging to someone else. You are not permitted to impersonate another person or entity, or mislead as to the origin of any content.

Vinopic Wines reserves the right but not the obligation to remove any content at its discretion.

When, and if, you post content on the Vinopic Wines website, unless indicated otherwise, you:

a) Grant Vinopic Wines and any of its affiliates a non-exclusive, royalty-free and fully sub-licensable right to use, publish, reproduce, adapt or modify, distribute, translate, create derivative works from, and display such content throughout the World and in any media.

b) Grant Vinopic Wines and its affiliates and sub-licensees, if they choose to do so, the right to use the name that you submit in connection with such content.

c) Agree that the rights you grant above are irrevocable during the period of protection of your intellectual property rights associated with such content and material. You agree to waive your right to be acknowledged as the author of such content and your right to object to derogatory treatment of such content.

d) You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Vinopic Wines, the content and material is accurate; use of the content and material you supply does not breach any of Vinopic Wines’ guidelines or policies and will not cause damage to any person or entity (including that the content or material is not defamatory). You agree to indemnify Vinopic Wines and its affiliates for all claims brought by a third party against Vinopic Wines or its affiliates arising out of, or in connection with, a breach of any of these warranties.

15. Right To Terminate

You have the right to close your account with Vinopic Wines at any time. If for any reason you would like to do this please just contact Customer Care to do so.
